What is mediation?

Mediation is a voluntary process for resolving disputes. In mediation the parties retain full control of the process. Mediation consists of a meeting between a neutral mediator and the parties with or without attorneys. The meeting can be in person or online depending on the preference of the parties. During the mediation the parties also decide how much time they prefer to spend together or in separate rooms working on solutions. The meeting rooms are private office spaces which are safe and comfortable.

The role of the neutral mediator is to help both parties develop their own solutions to resolve their dispute. There are many approaches the mediator can use to help the parties cooperate and work towards achieving their own solutions. However, no one will ever be pressured or forced to reach a settlement. After the meeting, the mediator will prepare a written agreement containing the solutions reached by the parties. If a full agreement is not reached, then the parties are free to return at a later date for a follow up mediation to try and resolve any remaining issues. They can also choose to pursue litigation through the court process. However, mediation is always available when both parties have the desire and the will to resolve their dispute.
